Houston teen charged with killing NFL player dad and mom in Bellaire blames prostitution ring

Despite a defense witness on Monday who offered few details to help a Bellaire teen charged with murdering his parents, his defense lawyers insisted they will continue efforts to get the charges dismissed.

Lawyers for 18-year-old Antonio Armstrong Jr. said Harris County prosecutors concealed claims that his father, a former NFL player, was involved in prostitution ring and received death threats. They are trying to bolster a defense theory that the couple was murdered during a home invasion, and not by their son.

The lawyers spoke to reporters after a special hearing in which a Houston woman testified that she told police that Antonio Armstrong Sr., a former Texas A&M standout and Bellaire entrepreneur, might be involved in a prostitution ring with her ex-husband.

“I believe there could be a connection,” Maxine Adams testified.

Adams said she was suspicious of her husband and went to Houston police because he was close friends with Armstrong, who had been killed five months earlier. Neither her husband, nor the older Armstrong, have charged with being involved with prostitutes.

Except for a smattering of phone records, Adams offered no evidence of a prostitution ring and could not remember who told her about the death threats or that Armstrong had changed his life insurance police shortly before he was killed.

The lack of evidence was seized on by both sides.

John Brewer, an Assistant District Attorney, cross-examined Adams on how little she remembered about the serious criminal allegations, including not remembering the identity of the private investigator she hired.

Defense lawyers said after the hearing that they were deprived of the ability to investigate the allegations of prostitution or see records that Adams no longer has.

“What we’re trying to prove is that because of the 18-month withholding of this evidence, we cannot recover from that,” said defense attorney Rick DeToto. “We’re learning that there was stuff available to us back in December 2016 that is no longer available, so, in our minds, that has caused harm to this young man and we don’t believe he can get a fair trial.”

State District Judge Kelli Johnson denied the motion to dismiss charges in June, but allowed a hearing Monday so the defense could question Adams about her allegations.

At the center of the allegations is an audiotape of the interview Adams gave Houston police. Her story bolsters the teenager’s story that the couple was killed in a home invasion, defense attorney’s contend.

Armstrong was 16 when he was arrested on a charge of capital murder, accused of fatally shooting his mother, Dawn, and father in their beds on July 29, 2016.

“The reason the audio is so important is because she’s very specific about this prostitution ring. She gives names, she gives phone numbers, she gives how it works, she talks bank accounts and Facebook stuff,” DeToto said.

Three months after Adams gave her interview, prosecutors told DeToto and fellow defense attorney Chris Collings about the allegations, but said they were not credible.

Prosecutors did not mention the audiotape of the interview that had specific information that could be investigated by police. Little was apparently done to investigate Adams’ allegations, DeToto said.

After Adams gave her interview, HPD detectives told prosecutors they would open an investigation under a separate case number so the defense would not know about it, according to emails attached to court filings.

More than a year and a half after the interview, prosecutors released the audiotape and 50,000 pages of phone records on the eve of a possible start date of the trial in June.

That led the teen’s defense team to ask the capital murder charges dismissed.

The district attorney’s office filed a response saying the pre-trial remedy for a possible Brady violation – referring to a 1963 Supreme Court decision that mandates the release of favorable evidence to a defendant – is more time for the defendant to prepare for the trial, not a dismissal.

The judge then denied the motion and instead rescheduled the trial for March 2019.

DeToto also noted that they did not have that information during a hearing in March 2017 when Armstrong was certified to stand trial as an adult.

The older Antonio Armstrong, a former Texas A&M University football star who played professionally, and his wife, both 42, owned a small chain of fitness centers. He was also an assistant pastor at his mother’s Gulfton area church.

Their son called police at 1:41 a.m. and said he was hiding in an upstairs closet, according to prosecutors. He told police that he heard gunshots and saw a masked man inside the home. When police arrived, Armstrong disabled the home security system and let police in.

Police found a .22-caliber pistol and a note on the kitchen counter reading, “I have been watching for a long time. Get me.”

Prosecutors said there were no signs of forced entry within the home and that Armstrong’s story did not make sense. They also contend the teen’s parents apparently caught their son smoking marijuana in his room, and took away his car and cell phone. Police said found they found a crack pipe inside his room.

After his parents were found dead, Armstrong admitted to a homicide detective that he fired a gun in his room shortly before they were murdered, prosecutors said.

If convicted, he faces life in prison with a possibility of parole after 40 years.
